We kindly ask you to read the General Terms and Conditions, because by sending your order you confirm that you accept and agree with the General Terms and Conditions that are concluded as a contract between you and Agria Vino 2010 Kft. You accept that your order entails a payment obligation. If you do not agree with the content of these General Terms and Conditions, you are not entitled to view the content of the webshop and place an order.   1. Definitions

For the purposes of these Terms of Purchase:

  1. a) consumer: a natural person acting outside their own profession, self-employment or business activities,
  2. b) consumer dispute: any dispute concerning product quality, safety or relating to application of product liability disputes, service quality or to contracting and its fulfilment between the parties
  3. c) consumer contract: any contract between a consumer and an enterprise
  4. d) guarantee: compulsory guarantee as defined and regulated in Act V of 2013 on the Civil Code (hereinafter referred to as ‘the Civil Code’) and in separate legislation on consumer contracts,
  5. e) distance contracts: consumer contracts to deliver products or services in the form of a distance sales system, concluded without the simultaneous physical presence of the parties, where the contracting parties exclusively use means of distance communication for contracting,
  6. f) means of distance communication: any means of communication suitable for the physically distant parties to make a contractual consent, in order to conclude said contract. Such means may include forms with or without address, standard mail, advertisement in the press with the order form, catalogue, telephone, telefax and devices providing internet access,
  7. g) product: movable property as defined in Section 2 of this Terms of Purchase,
  8. h) enterprise: site operator, the legal person selling the products offered on this website, as defined in Section 1.
  9. Contractual products

Wine, sparkling wine selected by the consumer via the website operated by the company, the essential characteristics of which (producer, production area, alcohol content, etc.) the consumer is informed about when selecting the product and finalising the order.

The customer can get a more detailed description of the product by clicking on the name or photo of the selected product.

  1. Add to cart

After entering the quantity, the product is placed in a virtual shopping cart by clicking on the ADD TO CART button. Adding a product to the shopping cart does not create a payment obligation. If you would like to add more products to your shopping cart, continue surfing and add the products you would like to buy to the cart. The shopping cart automatically calculates the total amount of your order.

During the ordering process you can view or change the contents of the shopping cart. If the shopping cart does not contain the desired quantity, enter the quantity to be ordered in the input field in the QUANTITY column and press the UPDATE CART button. If you want to remove the items from your shopping cart, press the red marked X-button in the left column. If you do not wish to purchase any more products and the quantity and price of the products are correct, click on CHECKOUT.

  1. Registration

The purchase in the webshop is subject to registration. If you register, you will be able to shop faster next time, check the status of your orders and have an overview of your previous orders. To register, you must enter a password under BILLING INFORMATION. If you are already a registered customer, clicking on “Click here to log in” will automatically fill in the previously used fields.

  1. Providing purchase, shipping and payment information

When ordering, all necessary billing information (first name, last name, address including country, street, house number, city, county, zip code, e-mail address, phone number) must be provided. The webshop automatically saves your billing information as shipping information. If your billing and shipping information is different, you will need to check the box next to “SHIPPING TO A DIFFERENT ADDRESS?” and enter your shipping information. When entering your order details, you can select the delivery and payment method for the product. In the field ORDER NOTES you can enter information about your order.

  1. Completing the order

If you check your order and find that everything is in order, please submit your order by clicking on the PLACE ORDER button. By sending your order, you agree to the General Terms and Conditions of the webshop and accept that your order entails a payment obligation.

In the case of orders in the webshop, the Buyer shall be deemed to be the bidder, so that a contract between the Buyer and the Seller shall not be concluded until the Seller accepts the offer made via the webshop. An automatic order confirmation by email from the webshop does not constitute acceptance of the offer.

Your order details are automatically confirmed by an email sent to the address you have provided so that you can check the details. Your order is registered with the order number in the confirmation.
The contract is concluded implicitly, i.e. by confirmation by us.
The contracts concluded in written form and in Hungarian language will be filed and are also available later.

Correction of data entry errors

You can return to the previous step at any time before completing the order process and correct the data entered there. During the ordering process you can view or change the contents of the shopping cart. If the shopping cart does not contain the desired quantity, you can change this by changing the number of the “quantity” button for the respective product. If you want to remove items from your shopping cart, you can do so by pressing the X-button next to the item. During the ordering process you have the possibility to correct / delete the entered data at any time. Please make sure that the information you provide is correct before you complete your order or registration for the wine tasting. If you find an error after your order or registration, please contact our staff by phone (+36 30 6925860) or email (info@standrea.hu). If we receive your request after our confirmation, the contract amount may change according to the new information.

  1. Prices

The prices on the product pages are discounted and non-discounted prices that apply when shopping online.
All prices include VAT (27%).
The prices quoted do not include shipping costs, which are explained in more detail in Section 5.
The customers of the Gál Tibor Wine Club receive the discounts valid at the time of joining.

  1. Delivery

For purchases over HUF 20,000, we ship all over Hungary free of charge with the GLS parcel service, otherwise HUF 2,300 shipping costs apply. The expected delivery time is 3 working days.

  1. Terms of Payment

You can choose your payment method when ordering. You can also pay for your ordered items by cash on delivery and via a secure connection – through the Borgun payment system – with the types of cards accepted by Borgun.

  1. a) We accept: Visa, MasterCard

In the case of these cards, it is up to the issuing bank to determine whether it allows online use of the cards. If the bank that issued your Electron card allows the use of cards for online shopping, you can of course use your card in our webshop. For further information, please contact your card-issuing bank.

b) Payment steps

  1. When you click on the “Payment” button, you will be taken to the Borgun payment portal, where you can initiate the transaction by providing your credit card information.
    2. After entering the card details, please check that the data is correct.
    3. After that, the transaction processing begins.
    4. You will also be notified by email about the execution of your payment and redirected to your provider.
  2. Cancelling the order

You can change your order until the product is delivered to the parcel service. In this case, call +36 20 219 3264 or send an email to:

  1. Right of withdrawal

Within the European Union, buyers have the right to return goods not purchased in a shop within 14 dayswithout stating the reason and receive a full refund. The reason for the return can be anything – for example, that the buyer has changed his mind. In this case, call +36 20 219 3264 or send an email to brand[at]galtibor.hu.

The consumer can exercise his right of withdrawal by using a withdrawal form (to be downloaded here) or by making a clear statement to that effect.

The withdrawal period of 14 days starts from receipt of the ordered goods. If the last day of the two-week period falls on a public holiday, this period shall end on the following working day.  The consumer may also exercise his right of withdrawal between the date of conclusion of the contract and the date of receipt of the goods.

In case of a written withdrawal it is sufficient to send us the withdrawal statement within 14 days.

Our company can demand compensation for the reduction in value due to a use that goes beyond the use required to determine the nature, characteristics and performance of the product.

The customer has no right of withdrawal for health or hygienic reasons if the product has been opened and therefore cannot be returned and the right of withdrawal cannot be exercised for custom-made products either.

In case of a return, the costs of the return shipment are to be borne by the consumer.

Refunds

As required by law, we will refund the purchase price of the product by bank transfer within 14 days of receipt of the withdrawal notice, but may delay the refund if we have not received the product.

If you have also paid shipping costs, we will refund them in addition to the purchase price. However, if you have not requested a standard postal delivery (but e.g. express delivery service), the dealer is entitled to charge you for this.

  2. a) Complaints regarding the delivery
    We take full responsibility for your order until you receive the goods. Defective or damaged goods will be replaced within 5 working days at our expense.
    Once you have received the goods, we can no longer accept delivery complaints.
  3. b) Complaint handling

Oral complaints are immediately investigated and, if necessary, resolved. If it is not possible to follow up the complaint promptly, a record of the complaint and our opinion will be issued immediately.

A copy of the protocol will be

  • handed over to the consumer personally on site in case of a personal complaint,
  • in the case of an oral complaint made by telephone or other electronic means of communication, the copy of the protocol shall be sent to the consumer at the same time as the reply; otherwise the procedure shall be the same as for a written complaint.

The Consumer Protection Act divides the oral complaint into a complaint made personally or otherwise. According to the regulation, there is a clear obligation for companies, therefore we also record verbal complaints (e.g. made over the phone or Skype).

Oral complaints made by telephone or electronic communications service will be given a unique identification number. The use of a unique identification number contributes to the traceability of the complaint. This number will also be communicated to the customer.

 We will respond to the complaint in writing within thirty days of receipt of the written complaint and take steps to communicate it (to the consumer).

A record of the complaint and a copy of the reply shall be kept for five years and made available to the control authorities on request.

If we reject your complaint, you have the right to lodge a consumer complaint against us with the conciliation board competent according to your place of residence or stay. The conciliation board proceeds at the request of the consumer. A precondition for the consumer to turn to the conciliation board is that they try to resolve the dispute directly with the company. Direct dispute resolution can be done in person at the company’s customer service, by phone or by email. A further condition is that the request for a procedure of the conciliation board to be submitted to the chairman of the board must contain the following:
name, place of residence or stay of the consumer;
name, registered office or place of business of the company with which the consumer is in dispute;
if the consumer wishes to submit his application to the conciliation board competent for the place of performance of the contract, the consumer must indicate the place of performance of the contract;
the opinion of the consumer in the present case and all the facts and evidence supporting his own opinion;
a statement by the consumer that he has tried to resolve the dispute directly with the company;
the consumer should also declare that he has not initiated a dispute resolution procedure with another conciliation board, a mediation procedure or civil proceedings in the present case;
the request must state what you expect and what decision you expect from the conciliation board.
Finally, the request must bear the signature of the consumer
In addition, the request must be accompanied by all documents to which the consumer refers as evidence, as well as all documents showing that the consumer has tried to resolve the dispute with the company but failed to do so.

We would like to inform you that our company is obliged to participate in the proceedings initiated by the conciliation board.

Court procedure

In the event the consumer chooses not to address a conciliation board, or the procedure closed without a result, the consumer has the right to request that the court settle the dispute.

The procedure is initiated with an application containing the following information:
the court in charge;
the names, addresses and procedural status of the parties and their representatives;
the piece of legislation to be enforced with the underlying facts and their evidence;
the data establishing the jurisdiction and competency of the court;
an explicit request for the court’s decision (statement of claims).
Attach any documents or their copies, that the application refers to as evidence.

Online dispute resolution platform
The European Commission has set up a website where consumers can register, and then they have the opportunity to resolve their disputes related to online shopping by filling in an online form, and they can avoid legal proceedings. In this way, consumers can exercise their rights without (e.g.) being hindered by distance.

Each member state of the European Union, including Hungary shall designate and operate an online dispute resolution contact point that shall host at least two online dispute resolution advisors who help the parties concerned by a dispute, if they have any questions related to the procedure. In Hungary, these tasks are performed by the Budapest Conciliation Board.
